Tank calibration errors, NDT inspection certificates, and risk assessment reports are all professional outputs that can give rise to professional liability claims. For Singapore engineering consultancies, NDT inspection firms, and industrial measurement specialists, professional indemnity insurance is the primary financial protection against the consequences of professional error.

A tank calibration team produces a strapping table for a petroleum storage terminal. The table is used in custody transfer calculations for the next three years. A discrepancy is later identified between the calibrated volume and the actual volume. The terminal operator brings a claim against the calibration firm for the financial loss arising from the measurement error across thousands of transactions.

An NDT inspection firm issues a certificate confirming the structural integrity of a pipeline weld. The pipeline fails eighteen months later at that weld location. The operator brings a claim alleging the inspection was negligent and the defect should have been detected.

A risk and safety consultancy produces a hazard identification study for a process plant operating in a major hazard industry. The study is used to justify an operating decision. An incident occurs. Investigators review the HAZID study and find the relevant hazard was not adequately assessed.

These are not theoretical scenarios. They describe the categories of professional liability that engineering consultancies, NDT inspection firms, industrial measurement specialists, and technical services companies face in Singapore's oil and gas, petrochemical, marine, and industrial sectors. In each case, the liability arises not from a physical accident but from a professional act: a report issued, a measurement taken, a certification provided, or an assessment completed.

Professional indemnity insurance is the product designed to respond to this category of claim. For firms in technical and engineering professional services, it is not a peripheral consideration. It is the primary financial protection against the consequences of professional error.

What professional indemnity insurance covers for technical and engineering firms

Professional indemnity insurance covers claims made against the insured firm for acts, errors, or omissions in the provision of professional services. For a technical or engineering services firm, the professional services covered are the firm's primary output: the measurements, assessments, certifications, reports, and technical opinions it produces for clients.

The policy covers two categories of cost. The cost of defending the claim, from the moment the client's letter of complaint or formal claim is received, including legal representation, expert witnesses, and the technical investigation required to understand what happened. And any damages or settlement amounts awarded against the firm, up to the policy limit.

The defence cost element is often the more immediate concern. A claim alleging measurement error in a custody transfer calibration, or negligence in an NDT inspection that preceded a structural failure, involves technical complexity that requires expert evidence on both sides. The legal costs of a technically complex professional liability claim in Singapore can be significant before any liability is established, and before any determination of whether the claim has merit.

For technical and engineering firms, two features of PI insurance are particularly important to understand.

Claims-made basis. PI policies respond to claims made during the policy period, not to work performed during the policy period. A calibration table produced in 2023 that is still in use in 2026 can give rise to a claim in 2026. The policy that responds is the one in force when the claim is made. The policy in force when the work was done is not the relevant policy. This means continuous coverage without gaps is essential, and the retroactive date on the policy determines how far back the coverage window extends.

Scope of professional activities. The PI policy covers the professional activities described in the proposal form and policy schedule. A firm that has expanded its service offerings, moved into a new technical discipline, or begun working in a new industrial sector needs to confirm that the expanded scope is reflected in the current policy. A claim arising from an activity that was not declared to the underwriter may fall outside coverage.

The specific liability exposures in technical and engineering services

Industrial measurement and tank calibration

Tank calibration is a measurement service used in custody transfer, inventory management, and regulatory compliance. The strapping tables and capacity tables produced by a calibration firm are the reference documents against which product volumes are calculated and settled. An error in the calibration that produces an incorrect table creates a systematic measurement error that compounds across every transaction using that table.

For calibration work conducted to API MPMS, ISO 4269, or other recognised standards, the professional liability question is whether the firm applied the applicable method correctly and whether the deliverables meet the required standard. A calibration error that falls within the accepted uncertainty of the method is different from one that reflects a procedural failure. The distinction matters for how a claim is assessed, but both can give rise to a dispute that requires professional indemnity cover to manage.

Level of Concern Declarations produced under API 2350 for overfill prevention carry a specific liability dimension. These documents define the operating levels at which a storage tank facility must take action to prevent overfill. If an overfill event occurs at a facility that was operating under a Level of Concern Declaration, the firm that produced that declaration will face scrutiny as part of any investigation.

Drone mapping and 3D laser scanning outputs used for dimensional verification, volume computation, or as-built documentation may be used in regulatory submissions, engineering design decisions, or permit applications. Professional liability for the accuracy of these outputs arises from the moment the report is used in a consequential decision.

Non-destructive testing and inspection

NDT inspection services carry one of the most direct professional liability profiles in the industrial services sector. The purpose of NDT is to detect defects, anomalies, and conditions that could affect the integrity of a structure, component, or system. A certificate confirming the absence of a reportable defect is a professional opinion. If a defect exists that the inspection should have detected using the method applied, and that defect leads to a failure, the NDT firm is in the liability frame.

The liability exposure applies across conventional NDT methods, including radiography, ultrasonic testing, magnetic particle testing, and liquid penetrant testing, and across advanced methods. It also extends to Level III consultancy: an NDT Level III consultant who signs off on inspection procedures, qualifies personnel, or provides technical oversight carries professional liability for those functions.

For firms that supply NDT inspection manpower to client sites, the question of where liability sits when supplied personnel perform inspection work under the client's quality management system is a specific one. In many supply arrangements, the inspection firm's liability for the professional acts of its supplied personnel continues regardless of the client's QMS. Confirming how the PI policy treats supplied manpower versus directly employed inspection staff is worth doing at the next renewal.

Risk, safety, and engineering consultancy

Risk and safety consultancy for major hazard industries carries a professional liability profile that is directly connected to the consequences of the work. A HAZID, HAZOP, or quantitative risk assessment used to justify a safety case, an operating decision, or a regulatory submission is a professional opinion with potentially significant downstream consequences.

The scope of professional liability for HSE consultancy extends to the quality of the study methodology, the completeness of the hazard identification, and the accuracy of the risk assessment findings. For noise and vibration consultancy and other technical disciplines, the same principle applies: if the output is used in a consequential decision and the output is later found to be inadequate, the consultancy carries professional liability for that inadequacy.

For firms operating across floaters, subsea, and offshore engineering, the technical environments in which professional errors can occur are high-consequence by definition. The value of a professional indemnity policy that reflects the actual scope of work and the realistic consequences of a professional error in these environments is correspondingly significant.

What to check in a PI policy for technical and engineering services

For a Singapore technical or engineering services firm reviewing its PI policy, four questions are worth confirming at each renewal.

First, does the policy cover the full scope of professional activities the firm actually performs, including any new service lines, new technical disciplines, or new industry sectors entered since the policy was last reviewed? A firm that has added drone mapping, advanced NDT methods, or subsea engineering to its existing capabilities needs to confirm that the updated scope is covered.

Second, what is the retroactive date, and does it extend back to cover the full period during which current deliverables were produced? A calibration table or NDT certificate issued three years ago can still generate a claim today. The retroactive date determines whether that historical work is within the coverage window.

Third, what is the indemnity limit, and does it reflect the realistic financial consequences of a professional error given the clients, contract values, and technical applications the firm works with? A limit set when the firm was smaller or working on lower-value contracts may not reflect the current exposure.

Fourth, how does the policy treat professional services delivered by supplied manpower, subcontractors, or joint venture partners? Technical services firms frequently use a combination of directly employed staff and subcontracted or seconded personnel. The policy needs to address the professional liability that arises from work performed by all of these categories, not only direct employees.
